Intelligems, Inc. (“Intelligems,” “we,” “us,” or “our”) provides the Intelligems application ("the App”), in connection with our price testing and intelligence service ("the Service"), to merchants who use Shopify to power their stores. This Privacy Policy describes how personal information is collected, used, and shared when you install or use the App in connection with your Shopify-supported store.

Personal Information the App Collects

When you install the App, we are automatically able to access certain types of information from your Shopify account:

Orders, Cart, and Checkout Events, and associated analytics

Customer info

Product catalog information (including inventory)

Discount information

Shipping configurations

Shopify Account Store Details (Name, Email, Address, Phone, and other inputted contact information)

Additionally, we collect the following types of personal information from you and/or others who may access the App on behalf of your store once it is installed: name, email address, and phone number.

We also collect information from web sessions on your store, such as: IP addresses, web browser details, operating system details, time zone, currency, page views, referring/exit pages, and information about the cookies installed on the particular device.

We collect personal information directly from the relevant individual, through your Shopify account, or using the following technologies:

Webhooks to collect cart, checkout, and order events from Shopify

Page View tracking that track site actions and generate logs around the web sessions, as outlined above.

First-party cookies to connect page views across sessions. “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org.

Advertising Platform Data

Connected Advertising Accounts; Meta Platform Data. If you choose to connect an advertising platform account to the App, we collect information from that platform on your behalf and at your direction. For Meta (including Facebook and Instagram), this may include ad account, campaign, ad set, and ad names and identifiers; advertising spend, impressions, clicks, and other delivery and performance metrics; ad creative content, including images, video thumbnails, headlines, and body text; destination URLs and associated tracking parameters; conversion and revenue metrics reported by Meta; and access tokens, account identifiers, and other authentication or technical information necessary to establish and maintain the connection (collectively, “Meta Platform Data”).

The Meta integration currently accesses Meta Platform Data on a read-only basis. We do not use the Meta integration to create, edit, pause, or otherwise modify campaigns, ad sets, ads, or other content in your Meta advertising account. You may disconnect the Meta integration at any time from within the App, which stops all further collection through that connection.

How Do We Use Your Personal Information?

We use the personal information we collect from you and your customers in order to provide the Service and to operate the App.

Additionally, we use this personal information to: Communicate with you; Optimize or improve the App; create aggregated data benchmarks; and provide you with information or advertising relating to our products or services.

We use Meta Platform Data solely on behalf of and at the direction of the merchant whose account it came from to provide and support the Service for that merchant. This may include helping the merchant (a) interpret results shown in the App, (b) understand the performance and quality of traffic originating from particular advertisements, and (c) identify opportunities to test or personalize its store. Meta Platform Data is made available through the App only to authorized users of the merchant account from which it was obtained. Intelligems and its service providers may access or process Meta Platform Data only as necessary to provide, operate, secure, and support the Service for that merchant, subject to contractual restrictions applicable to such service providers.

We do not use Meta Platform Data for other merchants, include it in cross-customer or aggregated benchmarks, or use it for Intelligems’ own marketing, advertising, partnership, or other purposes unrelated to providing the Service to the applicable merchant.

Sharing Your Personal Information

We don’t sell your customers’ personal information or disclose it to third parties for their own independent purposes. We may disclose personal information to service providers that process such information on our behalf as necessary to provide, operate, secure, and support the Service. We may use your information for marketing and partnership purposes; however, we do not use Meta Platform Data for those purposes. Meta Platform Data is used and disclosed only as described above.

We may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

Data Retention

When you install and use the App, we retain account and other data as necessary to provide the Service and in accordance with our contractual obligations and applicable law. If you uninstall the App or otherwise revoke our access to Shopify data, we stop collecting new data through Shopify. We delete personal information retrieved through Shopify APIs within 30 days after revocation of access or termination or expiration of the applicable agreement, unless retention is required by applicable law or the merchant has instructed us in writing to retain the data for a defined period. Residual copies in backups or logs may be retained temporarily in accordance with our standard data lifecycle procedures.

Meta Platform Data. We retain Meta Platform Data only for as long as reasonably necessary to provide the Service for the applicable merchant and otherwise in accordance with Meta’s applicable terms and policies. Disconnecting a Meta account stops further collection from that account. Previously collected Meta Platform Data may remain available as part of historical analytics while reasonably necessary to provide the Service to the merchant, unless deletion is requested. Upon a verified request to delete Meta Platform Data, or when the applicable merchant no longer maintains an Intelligems account, we will delete or irreversibly de-identify the applicable Meta Platform Data as soon as reasonably practicable, generally within 30 days, except to the extent retention is required by applicable law or regulation. Changes

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
